Yes. But overturning a conviction would have to come from a higher court (i think. gotta check my notes). But a re-trial (and thus a stay of his execution) should have been issued if the judge presiding over the hearing ordered by SCOTUS agreed that the state's case was not ironclad, and that some doubts were raised. The "system" failed Davis.

And apparently the GA governor no longer has the power to stop executions. It's not in the hands of the review board. Which is some bullshit to me, but whatever.

There is a lot of press on the 7 who "recanted" but a lot of what they said was brought up during the trial. And if they all conspired than the blood is on their hands because it was their testimony that got Davis offed.
At the trial, Harriet Murray, a friend of Young's, (the homeless guy getting his ass kicked that ultimately drew MacPhail over in the first place) emphatically identified Davis as the officer's killer, testifying: "When he was shooting the police, he had a little smile on his face, a little smirky-like smile on his face."

Its hard to ignore shit like that.

Maybe, but it's hard to also ignore 7 of 9 witnesses saying that tehy felt pressured by police to finger davis for the murder.

I don't know if he did or didn't commit the crime, but I do know the justice system him failed him because you don't take a mans life when there's any bit of doubt about his guilt.

Or jurors now saying they wouldn't have convicted if they knew then what the 7 jurors are saying now.

So these 7 witnesses are saying they were scared of the cops, or whatever they are now saying, to try and make themselves feel less culpable or deflect attention from the unmistakable fact that they are ultimately directly responsible for the death of this guy. From what is available to read on this case there seems to be no doubt it was either Davis or Cole (if you believe Davis' lawyer) who did the shooting. Cole wasn't arrested, tried, convicted of anything and hasn't been heard from yet Davis' lawyer tried to throw him under the bus. It seems that a perfect storm of 7 lying assholes (if their recanting is to be believed) and an incompetent lawyer get can a man executed.

I am 100% for the death penalty in cases where it is absolutely certain that the accused is guilty. I also think that once the sentence has been handed down, the guilty party should be executed immediately following the trial...........I'll even go so far as to say that they should have the fucking gallows right outside the court house!

9 witnesses testifying Davis was there and that he was the shooter is not a lack of evidence.
9 people testified, he was convicted and sentenced to death.
Now, because their testimony is crucial evidence in a man being put to death 7 of them want a "do over"?
Sadly it doesn't work that way.
Davis' blood is on their hands if they lied.

Like slapping a child's hand you can only hope that the temporary punishment you inflict will modify future behaviors! Give or take a few decades the lesson seems to have taken hold.
